Maybe Tom Delay was right. Maybe we do have to beware activist judges. When the Supreme Court is willing to abandon 90 year old case law and admit, in Mark Moller's words,

...is “let’s pretend originalism” — a Potemkin fidelity to the old ways,
robbed of any force by a deceptive, lawyerly slight of hand.

what is left to be taken away?
